Remi Momodu fights domestic violence through film

US-based Nigerian actress and producer, Remi Momodu has commenced her fight against domestic violence on African women in diaspora as he concludes plans to premiere her much talked about debut feature film,” XYZA” in Nigeria.

 

 
The film which premiered in Baltimore last year addresses the stigma associated with domestic violence among Africans in diaspora. Momodu expressed her heart-felt desire to create awareness for this topic that no one wants to talk about. She was in Nigeria last week to promote the film.

According to her, “This is of interest to me because the situation is very rampant in the place where I live in the United States. In recent times, we’ve had major cases where African men, particularly Nigerian men, who travelled back to Nigeria and brought their women back to America, many of the times, they are usually in the heath care business. They are interested in having affairs with registered nurses and people that are in the medical profession. For them, having anything to do with these people will help them regularize their stay abroad. They become cash cows where they can make more money. Because there was no courtship, the couples are always having misunderstanding. There were incidents where we actually lose these women to domestic violence.”

Speaking further, she narrated an incident where a Nigerian man shot his wife to death and also took his own life because of irreconcilable differences. “ Before I came to Nigeria two weeks ago, we had a case. A Nigerian man married to an Igbo lady shot her to death. She had a five months old baby in the house with her mother and a seven year old son too. He also took his own life. They were all gone. So there are five children left. He had three children from Nigeria and two in America; so, five kids with no father or mother. So the story continues. It’s an endemic problem, it’s a public health issue.”

She said, her aim is to draw attention to this social problem by partnering notable organizations to create awareness for domestic violence. The movie stars actors from Ghana, Cameroon and Nigeria including, Ejike Okoye, the mother of three and ambassador described XYZA as a campaign against demotic violence. Apart from product films, Momodu is a registered Nurse, an actress, a fashion designer and an entrepreneur.

SENATE President Bukola Saraki has assured the immediate family of the late Minister of State for Labour and Employment, Chief James Ocholi, his wife and eldest son of his full support.

Senator Saraki who noted that the uprightness and good works of the late minister will continue to speak in favour of the family in particular and the government and people of Kogi State in general, however urged the family not to see the burial as the end of the road “seeing that the late Ocholi had sufficiently immortalized himself through his courageous and exemplary life style during his brief sojourn on this earthly plane.”

   

Saraki in a statement by his Special Adviser, Media and Publicity, Yusuph Olaniyonu, in Abuja said that he was yet to recover from the shock resulting from the loss of such a great Nigerian and one of the leaders of the North Central, adding, “Ocholi’s life, though brief, was dedicated to the service of God and humanity. This single realization ought to cheer us rather than make us shed tears over his sudden transition to the great beyond.

“Yes, it is difficult not to give way to emotions in circumstances of this nature, but his godly qualities give us hope – a hope that should mitigate our anguish. It is painful that he left us when his services were most needed, but we are comforted that he had proved his mettle as a legal luminary and politician to the satisfaction of all,” Saraki stated.

While praying God to grant the souls of the departed eternal life, he assured his children of his support always.

Also yesterday, President of the Senate, Bukola Saraki expressed shock over the sudden death of a House of Representatives member representing Nasarawa/Toto Federal Constituency of Nasarawa State, Hon. Musa Baba Onwana, describing him as a fine parliamentarian.

In a Statement issued and signed by the Special Adviser, Media and Publicity, to the President of the Senate, Yusuph Olaniyonu in Abuja, Saraki who noted that the nation has lost one of its best hands in parliamentary business, described the late Onwana as a committed and God-fearing man who lived and served humanity with passion, adding, “ I was shocked and disheartened at the news of the death of Hon. Musa Baba Onwana. His patriotism and love for his constituents endeared him to many. “Onwana lived an exemplary life. As a teacher and a lawmaker, he was so disciplined and faithful in his dealings. We shall sorely miss him.”

The Senate President however urged the Speaker, Yakubu Dogara and all members of the House of Representatives, the Nasarawa State Government, the people of Nasarawa/Toto Federal Constituency and the immediate family of the deceased to take solace in the fact that late Onwana lived a good life. He was a man of good faith.
He prayed for the soul of the departed colleague to find rest in the bosom of the Almighty God and his immediate family and loved ones the fortitude to bear the loss.

Jude Okoye distances self from Psquare


Jude Okoye, the elder brother of estranged singing duo (Peter and Paul, popularly known as PSquare) who doubles as their manager, has distanced himself from the group, announcing that he is no longer the manager.
Jude took to his Twitter handle, to announce that he is no longer the manager of the Africa’s most popular singing duo, PSquare.

   

‘Please i stopped being Psquares management for over a month now (for the 4th time). Let me be at PEACE. Thank you,’ he posted on Twitter.

It will be recalled that in February, Peter announced that Jude is no longer the manager of the group.

In a series of tweets, Peter who has been on a business trip in the United Kingdom lamented the poor management style of their brother, warning everyone to desist from doing any business on behalf of P’square with Jude.

However, Paul faulted Peter, taking side with Jude.

FG to prioritise operations of police-Osinbajo


Vice President Yemi Osinbajo has promised that the Federal Government would prioritise the reform, re-orientation and re-equipment of the Nigeria Police.

Osinbajo made the promise on Friday in Abuja at the inauguration of operational vehicles for the deployment of policemen to liberated communities in the North-East.

In his speech at the occasion, Osinbajo described the police as “a critical actor in the criminal justice system of the country.’

“Consequently, any nation that is desirous of national security, economic development and democratic governance must of necessity be determined to evolve a people friendly and rule of law compliant police force,“he said.

The Vice President noted that it was based on this that Preseident Muhammadu Buhari approved the recruitment of 10,000 personnel and extra budgetary attention extended to the police.

He said that the government had also explored diplomatic channels for capacity building and functional training designed to reposition the police.

He said that with the inauguration of the vehicles, effect had been given to the initiative of government to deploy police to the North-East.

“It is the expectation of the government that with the acquisition of operational assets, the capacity of the police to support the integration process in the north-East will be engendered, “he said.

Osinbajo added that with the acquisition of the operational vehicles, the challenges of kidnapping and organised crimes which had threatened the nation’s security would be a thing of the past.

He commended policemen who paid the supreme price in the fight against terrorism and other internal engagements.

He urged serving police personnel to remain courageous and professional in the discharge of their duties and promised that the federal government would provide all necessary logistics to stabilise communities in the North-East.

Earlier, the Inspector-General of Police, Mr Solomon Arase said that the vehicles would be deployed as part of logistics for security stabilisation in the North-East.

He said that the vehicles would also be deployed to strengthen other internal security operations of the police, including safer highway patrol scheme across the country.

“As of today, over 600 vehicles have been deployed in this internal security architecture,“he said.

The I-G promised that the momentum to reposition the police would be sustained as a legacy to be bequeathed to Nigerians by this administration.

Sambisa Forest: Chief of Army Staff, Buratai has vindicated me — Omokri


Reno Omokri, former New Media aide to President Goodluck Jonathan, has said that the recent declaration by the Chief of Army staff, Lieutenant General Tukur Yusuf Buratai, that Sambisa is as big as Enugu, has vindicated him.

In June 2014, Omokri, tweeted that Sambisa Forest was larger than the whole of Lagos and Nigerians should commend the armed forces for the difficult job of routing terrorists from the forest. He was accused of lying by loyalists of the then opposition party, All Progressives Congress, APC, who attacked his claim and widely mocked him.

However, Buratai speaking to the officers and men of the 82nd Division of the Nigerian Army on Thursday vindicated Omokri by confirming that Sambisa is not only bigger than Lagos state, it is also bigger than Enugu state.

“We are already in Sambisa forest, but Sambisa is as big as Enugu state, which needs thorough planning for logistics and other manpower needed,” he said.

He further said that the size of Sambisa “accounts for the delay in flushing out the insurgents.”

In terms of size, Enugu state is 7,161 km2 (2,765 sq mi) while Lagos state is just half of the size of Enugu state at 3,577 km2 (1,381 sq mi).

Reno Omokri had repeatedly appealed to Nigerians to be patient with the army over the issue of sweeping Sambisa off terrorists, an appeal that was dismissed by the then opposition.

Detention: Fayose says DSS gradually becoming oppression tool for APC

Ado-Ekiti-Ekiti State Governor, Mr Ayodele Fayose has described the denial of the Department of State Services (DSS) that it was not aware of any court ruling, ordering the release of  the detained Ekiti State House of Assembly member,  Hon Afolabi Akanni, as “ridiculous, height of executive rascality and open display of contempt for the rule of law”.
Fayose said it was the highest point of wickedness and barbarism  in a democratic  setting,  for a Nigerian to be arrested  by  DSS and kept behind bars for 15 days without coming out openly to state his offence.

He called the attention of Nigerians to the alarm raised on Thursday that Akanni had died  in detention, saying he did this because the DSS had kept the whole Ekiti in abeyance about the health status of the lawmaker.

Governor Fayose, who spoke through his Special Assistant on Public Communications, Lere Olayinka,  said  the fact that Akanni told journalists that he slumped twice in detention on Wednesday gave credence to the alarm raised about his ‘purported’ death.

He  said the DSS should tell Nigerians “when Hon. Akanni committed those offences amounting to breach of security? Did Hon. Akanni plot coup or is he leading insurgents to warrant his detention without trial?

“We wish to reiterate that government addressed the press yesterday based on the information available to it and since the DSS was not talking to anyone concerning the status of Hon Akanni, the government had no option than to bring the disturbing information to the public domain.

“From the picture of Hon Akanni that we saw on television and published in the newspapers, it is without doubt that he is terribly sick and in need of urgent medical attention , and disturbing state of health could have been informed  by his critical state of health”.

Fayose told the DSS to release Akanni or charged him to court , having

complied with the order of substituted service granted by Justice Taiwo Taiwo of the Federal High Court  on March 16, which ordered that the production warrant issued on DSS be published in a national newspapers.

The governor stated that since Nigeria is operating a constitutional democracy that it must release the detainee with immediate effect or charge him to court.

“While we are not questioning the rights of the DSS  to handle matters relating to breach of security, we however, wish to ask how and when in particular did Akanni  committed those offences amounting to breach of security? Did he plot a coup or led insurgents to warrant his detention without trial?

“If truly the DSS has evidence against him, he should be prosecuted , this is what they do in a civilized clime”, he said.

On the position allegedly canvassed by DSS that it has not been served the production warrant issued by federal high court in Ado Ekiti, compelling the agency to produce the suspect in court on March 16, Fayose said: “The court bailiff, one Araromi  Ademola was at the DSS office on March 14, but they refused to accept it.



“The DSS officers according to Araromi said they were acting on order from above. On March 16, the court ordered that they should be served through newspaper publication, we published on pages 36, 37, 38, 39, 40 and 41 of the Tribune edition of March 17. Can the DSS claims that it didn’t see the publication?”.



He appealed to well-meaning Nigerians to call the DSS to order and stop harassing officials of state government.

'Amaechi was never a psychiatric patient under my care'


Ahead of Saturday’s legislative election rerun in Rivers state, the immediate-past Commissioner for Health in the state, Dr. Sampson Tamunoiyoriari Parker‎ has dismissed reports that the former governor of the state and current Minister of Transportation, Rotimi Amaechi was once a psychiatric patient under his care.

Parker who disclosed this in a statement issued Thursday in Abuja said although such had been rumoured in the past, he is now compelled to react following what he said has now been used as a campaign tool by the Peoples Democratic Party PDP in the state.

He said ‎he was not aware of any episode of mental ill-health over the 15 years of working closely with Mr Amaechi as a friend and later as his Commissioner for Health.

“Rt. Hon. Chibuike Rotimi Amaechi was not my patient at the Psychiatric Hospital when I worked there. I have never diagnosed or treated him as a psychiatric patient. I am not aware he has any psychiatric or mental health issues”, he said.

He berated those fuelling the rumour which he said is now being used as political slogans at campaign grounds and even radio stations in Rivers State.

The statement reads in part : ‎‎”On May 29, 2015, my service as the Rivers State Commissioner for Health came to an end after 8 years. I was one of the longest serving Commissioners in the Amaechi administration.

“As I was leaving the office of Commissioner I also retired from the Rivers State Ministry of Health as a civil servant. Just a little diversion: Due to policies we initiated in the Ministry, most of my contemporaries were earning more money than I made as Commissioner for Health. I may not have been assigned to any medical facility but I still practiced medicine even while serving as Commissioner for Health.

“While it would have made sense, at least financially, for me to remain as a staff of Ministry of Health, I chose to leave. I left for the main reason that I wanted to take a break from politics. I knew that my continued stay in the RSMOH would open me up to being used as a political fodder for and against Rt. Hon. Chibuike Rotimi Amaechi. In that atmosphere it would have been impossible for me to work as a civil servant.

“However, I have decided to speak now because my name is being used in the social and electronic media for inordinate political purposes.

“Rumours, half-truths, innuendos, silly allegations and outright lies are being elevated to the level of facts. I don’t know how we arrived at this juncture in the politics of Rivers State, where nothing is sacred; everything and everyone can be sacrificed just to score cheap political points.

“The first time I heard this silly rumour was from Gov. Amaechi just before we left office. I saw the allegation as a joke. I was amused and did not take it seriously since we both know the truth. He knows I have never made any diagnosis of mental illness concerning him and I thought my energies were better applied to looking for daily bread for me and my family”, he said.

Bayern Munich defender David Alaba has signed a three-year contract extension, keeping him at the Allianz Arena until 2021.

The Austria international, who has played at left-back, centre-back and as a midfielder in Pep Guardiola's side, has now extended his stay at the Bundesliga champions into the next decade.

He told the club's official website: "I’m very happy and grateful that I can continue playing for the best club in the world.
I grew up at FC Bayern and I’ve experienced unbelievably wonderful moments here. We’re all hungry to add further trophies to the ones we’ve already won.

"There’s a lot I want to achieve here in the years to come and I’ll continue to give my best for FC Bayern."

Wenger rules out Ibrahimovic bid… for now


The Gunners boss has denied reports he is interested in the PSG striker, who is out of contract in the summer, and says he has enough quality strikers at his disposal

Arsene Wenger insists Arsenal are not presently pursuing the signing of Paris Saint-Germain star Zlatan Ibrahimovic.

The 34-year-old striker is set to become a free agent at the end of the season, with his contract at the French champions due to expire.

Ibrahimovic has enjoyed another stunning season in 2015-16, with 27 Ligue 1 goals to his name from 24 matches.

Arsenal and Manchester United have been linked with a free transfer swoop at the end of the campaign, but Wenger claims he has not given that any thought.

When questioned about a move for the striker, Wenger said: "At the moment, no - we are not on that case. We have other worries at the moment in the short term and we are not on Zlatan's case.

"Even at 34 he has a great season with Paris Saint-Germain. But at the moment you can understand that my priority before the Everton game is not to look at possible signings next season in the transfer market. 

"I'm just surprised by the name you forward me and at the moment we are not thinking of signing anybody."

Wenger still feels he has enough quality from the attacking resources already at Arsenal and thinks the team as a whole can help them to score more goals.

"I always believe let's improve the quality of our game and then the strikers will benefit from that," said the manager. 


Buhari names LADOL one of the most strategic investors in Nigeria


President Muhammadu Buhari has identified the unique contribution of the Lagos Deep Offshore Logistics base (LADOL) as one of the strategic investments in the country that currently drives the nation’s economy.

Buhari made the statement when he opened proceedings at the sixth African Petroleum Congress and Exhibition (CAPE VI) in Abuja organised by the African Petroleum Producers Association (APPA).
The President, who was represented at the event by Vice President Yemi Osinbajo (SAN), identified LADOL, which has invested over $600million in private investment, as one of the companies that currently adding the most value to the Nigerian economy through their ingenious investments.
This is coming as the Managing Director of LADOL, Dr. Amy Jadesimi, outlines plans to further attract $5billion investments into the country through the LADOL Industrial Free Zone located in Lagos within the next few years.

Dr. Jadesimi gave the indication, Thursday, while delivering a presentation at the event under the topic: Driving Economic Growth Through Local Private Sector Investments in Nigeria.

She noted that given the spate of growth at the zone, “the success of LADOL has attracted new investors to Nigeria who partner with credible Nigerian investors leading to the creation of dozens of similar facilities”.

She noted that in 2010 alone, 130 oil rigs were towed from West Africa past the tip of Africa across the Indian Ocean to the Far East for repair adding that “with LADOL and similar facilities now on ground, more of such ventures would be done in Nigeria.“

While lauding the efforts of the indigenous organization in building economic growth, the President similarly gave accolades to Samsung Heavy Industries (SHI), which is currently building one of the world’s largest oil platforms at the LADOL base in Tarkwa Bay, Lagos.

The LADOL/SHI project commonly referred to as Egina Floating Production Storage and Offloading (FPSO) platform valued at $3.8billion, is said to be first of its kind to be built in the sub-Saharan Africa.

According to the President who urged other investors to emulate the LADOL example, African countries should develop ingenious ways of promoting value addition and investments through sustainable policies in local content.

Reports indicates that through the LADOL/SHI FPSO project, the industry has been boosted with 5,000 direct jobs and 0ver 50,000 indirect employments by leveraging on the Local Content Act 2010.

Appraising the local content achievements of the organization, the President noted that, “A common approach to local content will ensure that the whole of Africa benefits from economies of scale associated with our vast resources.”

President Buhari noted further that ongoing mega projects like the LADOL/SHI Oil Platform; the General Electric service centre for manufacturing rotating equipment in Calabar; and the Dangote Refinery in Lagos are some of the most strategic investment to an emancipated African economy.

The President who described LADOL industrial free zone in Lagos – a wholly indigenous, privately developed and hosting the largest shipyard in West Africa allied with the Samsung FPSO integration yard at the base, said the joint venture will aid Nigeria’s quest for her pride of place as a leading world economy.

The President stressed that the continent must recognize that the development of domestic refining capacity in the oil and gas sector would remain critical to sustainable economic growth. He also noted that Nigeria, which recently announced a new timeline to end gas flaring at her oil fields, was on course to see this out.
     



Ibinabo back in prison as bail bid fails

Embattled star actress Ibinabo Fiberesima, who was convicted by the Court of Appeal in Lagos on March 11, was yesterday unable to secure bail from the Court due to incompetent application.
The three man-panel, presided over by Justice UI Ndukwe-Anyanwu, said that the appellant failed to attach copies of the judgment that was delivered by the court which affirmed the five years jail sentence imposed on her.
The other Justices on the panel are Justice Samuel Oseji and Justice Tijani Abubakar.
When the matter came up yesterday, Ibinabo’s lawyer, Nnaemeka Amaechina informed the court of an application dated March 14 stating that he had also served the application on the Lagos State government  (respondent).

However, the application could not be heard as the court observed that the appellant failed to attach copies of the judgment of the court as exhibit thereby rendering the whole application incompetent.                                                                                                                                              Justice UI Ndukwe-Anyanwu, said the only option left was to strike out the application or adjourn it till further date for hearing.

Consequently, Amaechina sought for an adjournment to enable him do the needful. The court subsequently adjourned the matter till April 7 for hearing.                                                                    Meanwhile, Ibinabo has asked the Supreme Court to set aside the judgment of the lower court.  In her Notice of Appeal, the appellant stated that the Court of Appeal erred in law when it affirmed the alteration by the High Court of Lagos state by setting aside the option of N100, 000 fine and substituting it with a term of 5 years imprisonment.
 


What if Saraki is convicted?

Today’s scheduled resumption of the trial of the President of the Senate, Senator Bukola Saraki at the Code of Conduct Tribunal undoubtedly affirms the present administration’s mantra that no one is above the law. However, the political drama that shadowed the emergence of Saraki as the country’s number three citizen also paints the matter of politics as an issue in the trial.
Saraki is being tried on a 13 count charge including failure to declare his assets, operating a foreign bank account among other charges bordering on the violation of the code of conduct for public officers.

Today’s formal resumption of trial follows Saraki’s failed efforts to cut short the trial on the basis of what he cited as bias and political persecution. The Senate President had approached several courts reaching the Supreme Court, which all refused to stop the trial.

The Senate President had among others, cited the fact that the authorities failed to abide by the provisions of the CCT Act which in Section 3 (d) stipulates that the Code of Conduct Bureau, CCB should, first of all, notify a public officer of any issue the bureau may have against him or her before taking the case to the CCT. The Supreme Court, however, refused to consider that provision as it ruled that Saraki should face trial. Besides, Saraki had also sought to affirm the fact that the CCT as presently constituted does not form a quorum to try a case.

Political  witch-hunt

But beyond the legalese is the whispering claim by associates of the Senate President that the case against him simply arose out of political witch-hunt. Their claim is that if Saraki had not become Senate President that the issues surrounding his assets declaration when he was governor more than six years ago would not have arisen.

They have also sought to point at the fact that of the more than 5,000 public officers expected to declare their assets to the CCB that only a few have been brought to trial; remarkably, the last high profile person to have been brought to trial was the former Lagos State governor, Asiwaju Bola Ahmed Tinubu, whose case in 2011 was generally alleged to have been a scheme by the former Goodluck Jonathan administration to browbeat the then opposition leader.




Given Tinubu’s pre-eminence in the former opposition camp, it was alleged that the Jonathan administration wanted to humble him by making him face the CCT on issues that arose almost six years after he had left office. Remarkably, the Jagban as he is famously hailed by political associates overcame what was alleged to have been the political persecution of the Jonathan administration by citing Section 3 (d) of the CCT Act, to wit, to say that he had not been previously served by the CCB on any anomalies on his assets declaration.

The Saraki team according to sources are also hoping to project that fact when his case comes up today. But beyond the trial is the unfolding snare for the ruling All Progressives Congress, APC in the continued trial of Saraki. A conviction for Saraki could further destabilise the Senate to the amazement of the APC.

Unbeknown to many operatives of the APC, the party’s majority in the Senate outside senators aligned to Saraki may not be defensible. With the balance of the parties being APC, 59, PDP 44, and Labour 1 with four seats outstanding, the propensity of the mainstream APC to push through legislative proposals could be hampered should the about 30 APC senators aligned with Saraki team up with the opposition PDP.

It is a danger that the leaders of the APC have yet to contemplate. President Muhammadu Buhari, who could suffer the backlash the more according to sources, may not have serious issues with Saraki.

“Buhari’s problem is the presence of Senator Ike Ekweremadu in the office of Deputy President of the Senate and his anger is that Saraki helped Ekweremadu to that office.” The president’s angst against Ekweremadu is said not to be personal but rather, ideological. The president, sources said, is still miffed with the PDP and what the party did to him in his years in the opposition.

Should Saraki lose out in the emerging case, the Senate could be headed for a fresh leadership election in which the PDP now revitalised after its bruising losses in 2015, could as well challenge whosoever the APC could produce. Even with the lack of unity in the APC with its senators divided between the Unity Forum and Like Minds, it could become an enticement for the PDP to dare the APC by entering the fray with the assurance that APC senators inclined to Saraki could align with them.

16 Issues Metuh’s Counsels Have Against Justice Okon Abang


The embattled National Publicity Secretary of the Peoples Democratic Party, PDP, Chief Olisa Metuh, has asked Justice Okon Abang of the Federal High Court sitting in Abuja to hands-off his trial.

Metuh who is answering to a seven-count criminal charge the Economic and Financial Crimes Commission, EFCC, ‎preferred against him, urged the Chief Judge of the High Court, Justice Ibrahim Auta, to transfer his case-file to another Judge.

Excerpts from the petition revealed the 16 Issues Metuh’s Counsels have against Justice Okon Abang for which they requested for transfer of case.

The petition with Ref No. EES/01/11/03/16, dated March 11, 2016, was signed by one of the lawyers in Metuh’s team, Mr. Emeka Etiaba, SAN.

However, Justice Abang who disclosed that a copy of the petition was forwarded to him by the CJ on ‎March 16, at about 4pm, said he would not hands-off the case.‎

The facts relied upon by the Defendants in requesting that their case be transferred to any other Judge as given by the 1st Defendant are as follows:

1. Upon granting the 1st Defendant’s Application for bail on the 19th day of January, 2016, the learned trial Judge gave very stringent conditions of bail and part of the conditions was that two Sureties must be properties owners in Maitama Abuja and must submit their Statutory Certificate of Occupancy.

2. Due to the above stringent conditions, he spent another nine days in detention before the terms were varied and he achieved bail.

3. Immediately after his plea was taken, Honourable Justice Abang announced that trial will commence on 25/1/2016 and shall be on day-to-day basis. All attempts made by his Lawyers to urge the Court to give him time to meet the conditions of his bail, come out, get his documents (which he needs for his defence) and property brief them failed.

 
 

4. His trial therefore, commenced with the Court refusing to avail him the Constitutionally guaranteed right to reasonable time to enable him prepare his Case (Please see with respect, Section 36(6) (b) of the 1999 Constitution (as amended).

5. Throughout the conduct of the case of the Prosecution, the Honourable Justice Abang refused Applications made by his Counsel except where the Prosecution states that it is not opposed to the Application. The issue here is not the fact of refusal or grant of the Applications made, but the insistence of his Lordship that since the Prosecution has opposed same, the Court lacks discretion. The Court has said and acted on this severally.

6. The implication of the lack of discretion as expressed by his Lordship is that his Lordship’s discretion is tied to the Prosecution’s disposition in his own criminal trial. This fact portends danger to him.

7. On the 27th day of January, 2016 when this Case came up, one of his Counsel informed his Lordship that Dr. Onyechi Ikpeazu, SAN, the lead Counsel for the Defendants was engaged at the Supreme Court and the Defendants desire that he personally handles the proceedings that day because of its sensitive nature. The Counsel therefore asked for a stand down or adjournment. The Prosecution having opposed the Application, his Lordship rules that since Dr. Ikpeazu, SAN, did not send a letter, the Case must go on. His Lordship therefore, jettisoned the age long tradition of deferring to the Supreme Court in matters of this nature and not minding that this is a Criminal trial where the right of a Defendant to choose his Counsel is paramount (Please also see with respect, Section 36 (6) (c) of the 1999 Constitution (as amended).

8. In contrast my Lord, his Lordship has always differed to the Prosecution at any time the Prosecution applies for adjournment for reasons bordering on availability of witnesses. The record of Court will bear that the Prosecution has on more than one occasion asked for adjournment for lack of witness and was obliged without hesitation.

9. The Defendants are uncomfortable with the Rulings and Decisions of his Lordship in some of the Applications made by them and they decided to apply for the record of proceedings to enable them challenge them at the Court of Appeal by way of interlocutory Appeal. They applied through their Counsel for the record of Proceedings on the 8th day of February, 2016 but till date, his Lordship has not obliged them the record not minding that their case comes up virtually everyday and his Lawyers check on the registry on daily basis to know whether the record is ready. The Learned Trial Judge on 9/3/2016 personally confirmed to Miss Nancy Okoli, Counsel in our Chambers that the record is not ready as he must read and approve same personally. This was a month after the Application was made.

10. The refusal of his Lordship to oblige the Defendants the record for a period over one month and one week (for a trial that has seen only eight (8) witnesses and which record is not voluminous) has fully foreclosed their right of appeal on the decisions that will at the end of the day impact on the judgment in their case. This is a denial of fair hearing.

11. The Defendants view the refusal/failure of the Honourable Judge to release the Certified True Copy of the record of proceedings as unhealthy and is a manifestation of his Lordship’s determination to frustrate their defence and appeal.

12. On the 9th day of March, 2016, his Lordship delivered his Ruling on their No CASE submission and surprisingly, after warning himself of the need not to go into the substance of the case, went on in the open Court to state with respect to Counts 5 and 6 (which deal with transaction with regard to the sum of USD2m (Two Million Dollars) with a non-financial institution) that though the origin or source of the Dollars was not part of the Charge, the Defendants must prove it as that forms the basis of money laundering offence. By so doing, his Lordship introduced a perceived element of the offence that was not in the Counts.

13. The Ruling of my Lord in the NO CASE submission has been appealed against and the mention of the statement made by his Lordship while delivering the Ruling only serves to show the disposition of his Lordship in this trial. The 1st Defendant noted that such statements in the past have resulted in the amendment of Charge or procurement of additional Proof on evidence by the Prosecution.

14. Upon dismissing the NO CASE Application of the Defendants, his Lordship insisted that the Defendants’ must commence their defence immediately citing his decision on 25/2/2016. It took the Defendants’ Counsel’s Counsel’s repeated submissions to the effect that the Defendants’ witnesses are to be subpoenaed and before that day, the need to apply for subpoena did not arise as they believed their NO CASE Application will succeed for his Lordship to grant a very short adjournment. The Defendants then began to wonder whether the decision for them to begin their defence without preparing for it is in the interest of justice or whether they are being stampeded to jail?

15. Today, Counsel in our Chambers went for the umpteenth time to collect the long awaited Certified True Copy of the record and the Certified True Copy of the Ruling in the NO CASE submission and to her chargrin was informed that his Lordship said the Certified True Copies will be ready on or before Wednesday, 16/3/2016.

16. Bearing in mind the fact that trial has been adjourned to Thursday, 17/3/2016, his Lordship’s decision to release the Certified True Copies on or before Wednesday 16/3/2016 is a grand plan to further frustrate the Defendants and their appeal, which Notice of Appeal was served on the Court.

The Defendants believe that having been a part of the trial in this Case and having noticed the disposition of his Lordship in this Case, they ask themselves this pertinent question: Do we believe that Honourable Justice O. E. Abang will do justice in this Case? They went ahead to resolve the question in the negative hence a need for this very urgent and intervening letter.

The Defendants stated that they had resisted causing this letter to be written but have come to the inevitable conclusion that a Judge who denied them the inalienable right of appeal by withholding the record of proceedings amongst others will care less about whether they obtain justice in the same Case or not.

“May we therefore appeal to my Lord in the interest of justice to cause the transfer of this Case to be made to any other Judge in the interest of justice”


Forget Liverpool defeat, beat Man City, Van Gaal urges players


 Manchester United manager Louis van Gaal urged his players to put the disappointment of Europa League elimination by Liverpool behind them by defeating Manchester City in this weekend’s derby.

United were knocked out of the Europa League in the last 16 after a 1-1 draw at home to their arch-rivals on Thursday condemned them to a 3-1 aggregate defeat.

Their exit cut off one potential avenue to Champions League football next season and with United four points behind City, who occupy the fourth and final qualifying berth in the Premier League, Van Gaal knows that defeat at the Etihad Stadium on Sunday could be fatal.

“We have to beat Manchester City because that is the other chance to qualify ourselves for the Champions League,” he told his post-match press conference at Old Trafford.

With the FA Cup now the only competition United can win, Van Gaal was asked if failure to overcome Liverpool had increased the pressure on both him and his team.

“The pressure was also today,” the embattled Dutchman replied.

“Manchester United always has pressure. The expectations are always high. The pressure for these players is always very high. We know that and we can cope with that. But we were not lucky today (Thursday).”

Trailing 2-0 after last week’s one-sided first leg at Anfield, United halved Liverpool’s aggregate deficit in the 32nd minute when Anthony Martial lured Nathaniel Clyne into a rash foul and scored the resulting penalty.

But Philippe Coutinho restored Liverpool’s two-goal cushion on the stroke of half-time with a goal that manager Jurgen Klopp described as “genius” — the Brazilian leaving Guillermo Varela for dead and then dinking a shot past United goalkeeper David de Gea at his near post.

The game’s closing stages played out to a soundtrack of crowing chants from the away fans, but Van Gaal felt that his team had dominated to the same extent that Liverpool had in the first leg.

“We have played like Liverpool played in the home match with us,” said the United manager, who was presiding over his 150th European game.

“We have done that with them. We have created a lot of chances. We scored a penalty. (Jesse) Lingard, (Juan) Mata, (Marouane) Fellaini, Martial (had chances), and then you concede one goal in the last seconds.

“That’s what we did not do in Liverpool. They scored the away goal and that was the difference.”

He added: “I am not angry, I am not frustrated. I was very proud of my players. They have given everything.

“I was very pleased the fans also recognised that because they applauded after the match in spite of (the fact) we are out of the Euro League. That was remarkable, I think.”

While Van Gaal braced himself for more inquests about his United stewardship, Klopp remains on course to finish his first season at Liverpool with a trophy in his hands.

“Phil (Coutinho) had a genius moment, wonderful,” beamed the German, whose side will learn their quarter-final opponents in Friday’s draw.

“It was brilliant, what he did. It was the most unexpected thing you could do in a situation like this and it was a perfect goal.”

Klopp, who revealed that skipper Jordan Henderson had vomited at half-time, became the first Liverpool manager to avoid defeat on his first trip to Old Trafford since Graeme Souness in October 1991.

Asked if he would like to face former club Borussia Dortmund — 5-1 aggregate winners against Tottenham Hotspur — in the next round, he smiled.

“Dortmund, of course not. Why should I want the strongest team in the tournament in the next round?” he said.

“But if we go there, we try to win. I saw only a little bit of the other results, but I’m pretty sure there’s no easy games anymore. It’s not too important. Only we have to be prepared and hopefully we are.”
